The Agency declared that Article 3 of Executive Decree No. 140, given the current circumstances, is not justified The Plenary of the Constitutional Court declared the constitutionality of Executive Decree No. 140 of July 28, 2021, which contains the 30-day renewal of the state of exception in the province of El Oro and the city of Guayaquil issued by Decree No. 116 , by public calamity, produced due to the detection of cases of COVID-19 variants DELTA and DELTA DELTA ++ K 417N (AY.1).

—"The Agency ordered that the suspension of rights and the extraordinary measures ordered in Executive Decree No. 116 and ratified by the renewal of Decree No. 140, be carried out in accordance with the provisions of opinion No. 3-21-EE / 21 of July 21, 2021. Likewise, it declared that Article 3 of Executive Decree No. 140, given the current circumstances, is not justified and therefore becomes unconstitutional.

In addition, it insists that the competent bodies implement the means that the ordinary legal regime makes available to them, reiterating that inter-institutional coordination is essential so that there is timely attention from the different sectors involved in such a way that, the adoption of extraordinary measures within of a state of exception, including its renewals, have the justification and the exceptional character that this figure deserves.

Finally, it provides that the President of the Republic, once the period of renewal of the state of exception has concluded, submit the corresponding report to the Constitutional Court, in accordance with Article 166 of the Constitution.
